From Sebastian Bach to Shawn Gordon:
Hi
Swawn,
Just wondering when I can see the corrected publishing credits on the
packaging.
Also I am wondering when I can hear some of the mixes.
I have been cranking the roughs for tons of people & they
sound real good . Cannot wait to hear them even better.
Rock on
Sebastian

I'm not sure how to say this, and it will decidedly not make your
day. I'll say this as straight as I can. We bent over
backward to accommodate everything you wanted, the issue of credits and
publishing had just pushed it too far, especially when I had already
worked it out with Brett and that got thrown out the window at the last
minute. We all know this isn't about money because if this was
successful enough that the publishing was worth anything significant,
you will have made at least a million on your royalties. We're a
small company, we've got a lot of money in this, and we had to get it
done. I finally had to just give it to our attorneys because I
had exhausted my ability to deal with the legal minutia that was coming
up. Our attorney reviewed the contract and then called the
shots. I'll tell you, we were honestly about 5 minutes away from
scraping your vocals, writing off the money and getting another
vocalist, that's how big a problem it was on our end.
So here is the situation, the album is done, it has been manufactured,
I received part of the inventory yesterday and have already shipped out
several thousand units as of today. We've listed your credit and
publishing for the songs "Human Grain" and "Outcast" and will submit it
that way to ASCAP. The other 5 songs you wanted writing credits
on have been removed, if you choose to battle it out at ASCAP for those
5, so be it, we'll abide their judgement. Everything has been
done in strict accordance with the contract and at the direction of our
attorney. I tried very hard to keep this as positive as possible,
but every time I gave one thing, you wanted 2 things - this is mostly
my fault because I was too accommodating from the beginning, if I had
set the tone properly from day one, we probably wouldn't have gotten to
this point.
I think you're a great singer and a fun guy to hang with, no one is
trying to screw you here, and we aren't going to say anything negative
to anyone about you or what happened. I know this is gonna piss
you off, but it was out of my hands and I've been twisted up inside
trying to figure out how to deal with it. If you give me your
address and how many copies you want, I'll get the album sent out to
you.
